Release rules in Santa Clara County

  • Santa Clara County uses the Superior Court’s 2026 Criminal Bail Schedule; the bond is written for the amount it lists.
  • Charges that come from one act are priced at the single highest amount. Charges from separate acts are added together, and enhancements add more.
  • Misdemeanors the schedule does not list are released on a promise to appear, unless the person is already on bail, own recognizance, probation or parole ($10,000).
  • A few charges need a judge to review the case before anyone can be released on bail.
  • Every adult arrest in the county is booked into the Main Jail at 150 W. Hedding St., San Jose.
  • The case goes to the Hall of Justice in San Jose, the Palo Alto Courthouse or the Morgan Hill Courthouse, depending on the city where the arrest happened.
  • Release usually takes 6 to 8 hours after bail is posted.

Santa Clara County bail questions

Where does someone go after an arrest in Santa Clara County?

To the Main Jail at 150 W. Hedding St. in downtown San Jose, the only booking jail in the county. San Jose, Palo Alto, Gilroy and the other city departments may hold a person in station cells for a few hours, but adults are booked into the Main Jail, and that is where the bond is posted.

Which courthouse hears the case?

It depends on the city where the arrest happened. Campbell, Los Gatos, Milpitas, Monte Sereno, San Jose, Santa Clara and Saratoga cases go to the Hall of Justice next to the Main Jail. Cupertino, Los Altos, Los Altos Hills, Mountain View, Palo Alto and Sunnyvale cases go to the Palo Alto Courthouse on Grant Avenue. Gilroy, Morgan Hill and San Martin cases go to the Morgan Hill Courthouse on Diana Avenue.

How much is bail for a DUI or a domestic violence arrest here?

The court’s 2026 schedule lists $5,000 for a first misdemeanor DUI and $10,000 when the blood alcohol is .15 or higher. Misdemeanor domestic violence under Penal Code 273.5 is $10,000 and the felony version starts at $25,000. Tell us the booking charges and we read you the exact figure.

Why can’t some people be bailed out right away?

Santa Clara County’s schedule marks certain charges, such as cases with two or more strike priors, as needing a judge’s review before anyone is released. An officer can also ask a judge for higher bail than the schedule. In those cases we wait for the court’s decision, then post the bond the same hour.

Can a misdemeanor arrest end without bail?

Often, yes. The 2026 schedule releases most misdemeanors it does not list on the person’s own promise to appear. That changes when the person is already out on bail or own recognizance, or is on probation or parole: then the schedule sets $10,000.

Who makes arrests in Cupertino, Saratoga and Los Altos Hills?

Sheriff’s deputies from the West Valley Division on South De Anza Boulevard in Cupertino. All three cities renewed their Sheriff’s contracts in 2026. Their arrests are booked at the Main Jail in San Jose like everyone else’s.

My relative was moved to Elmwood. Does that change the bond?

No. Elmwood in Milpitas holds men and women who are waiting for trial as well as people serving sentences. The bond is still handled through the Sheriff’s Main Jail, and we confirm with the jail which building the person will be released from.
